Minnesota’s Section 125 “Requirement”

Speaker: Darcy L. Hitesman
Many employers have important decisions to make in 2009 regarding health coverage for their employees. The presentation provides (1) an overview of the new Minnesota Statute Section 62U.07 requiring certain employers to establish cafeteria plans to permit the pre-tax payment of individual health policies purchased by employees, (2) identification of unclear items, and (3) the interplay between the state mandate and the federal tax code.
At the end of this presentation, the participants will be able to:
- Basic information regarding the nature of the state mandate.
- Sufficient information to determine whether a particular employer is subject to the mandate.
- Information by which to evaluate whether a Section 125 Plan makes sense for a particular employer.
- How an employer subject to the mandate may comply with both the mandate and the federal tax code.
 Darcy L. Hitesman (J.D., with honors, University of Minnesota) practices employee benefits. She advises clients regarding the Internal Revenue Code, ERISA, HIPAA, FMLA, and state insurance laws. She represents employers and employee benefit plans of all sizes and types (for-profit, nonprofit, governmental entity, single employer, multiple employer and MEWAs), including third party service providers, health care providers, plan sponsors, employers, and benefits consultants. Ms. Hitesman is a frequent speaker to both legal and non-legal audiences on various employee benefits topics, Health Reimbursement Arrangements (HRAs), HIPAA, COBRA and FMLA topics, and coauthors ERISA Compliance for Health & Welfare Plans, published by the Employee Benefits Institute of America. Ms. Hitesman has been named a Super Lawyer since the year 2000. Ms. Hitesman has also been appointed to the Minnesota Racing Commission by Governor Pawlenty where she serves as Chair.
